Breitbart.com, ‘ISIS Developing ‘Colonies’ In Middle East As It Gains Credibility Among Jihadists’, dated 11/25, 2014:

“Jerusalem-based intelligence analyst Adina Kutnicki told Breitbart in an interview that ISIS’ expansion into Libya is definitely an offensive move.

“Wherever the Caliphate (ISIS) claims as its address and hoists its banner, rest assured, offensive jihad gains exponential traction,” Kutnicki said……

Adina Kutnicki says ISIS has further plans for expansion. She also told Breitbart that she believes ISIS’ will move on Saudi Arabia.

“I believe they will first target Saudi Arabia, for capturing the Kingdom brings them one step closer to controlling Sunni Islam. After which, the rest will be much easier to control, but in this order: Jordan, Lebanon and Israel. Rest assured, once they close in on Israel, Jerusalem’s nukes will be brought out, albeit the low yield ones,” Kutnicki said…..

However, Kutnicki believes ISIS has the power to move forward. She adds that in the push to enlarge its influence and territory, no city will be spared and the Islamic State will ignore Western leaders.

“Baghdad will not be spared, it is an integral part of their Caliphate plans. As to the west, they have no fear of the leadership of the free world and will not take any of the leaders into consideration,” Kutnicki said.

Kutnicki also says she takes seriously the recent reports that ISIS’ army numbers 200,000….

“I believe it is entirely possible that the 200,000 number is a close estimate, though proving it would be nearly impossible. World Net Daily, ’43 Islamists On Trial For Euro-Terror Plot’, dated 10/02/2014:

“Israel-based intelligence analyst Adina Kutnicki said the concern over ISIS is well founded. However, Kutnicki told WND in an interview that the jihadists’ point of origin should not be the focus.

“Firstly, whether they are recruited in Belgium, or any other Western nation, is not the issue. The fact that Islamic jihad has come full circle – spreading its wings from the Mideast, back into Europe, only to re-enter the Mideast – is in order to fulfill the main mandate. That’s the reestablishment of the caliphate,” Kutnicki said.

Former Air Force counter-intelligence officer and terrorism analyst Dave Gaubatz said any effort to downplay the ISIS threat to the U.S. is seriously misguided.

“ISIS and other Islamic terrorist groups, motivated by their Islamic ideology, are the world’s most dangerous threat. ISIS has money, followers, a military and a strategy for world conquest,” Gaubatz said.

Lopez emphasized ISIS fighters returning to Europe and the U.S. have two distinct advantages.

“Not only are these the most devout and practicing of all Muslims, but when they return from those battlefields they now have hardened battle skills that they learned and trained in over there. Further, they possess passports from European countries from which they may or may not need a visa to enter the U.S.,” Lopez said.

The ISIS motivation

Gaubatz said ISIS and like-minded groups are driven by one ingredient – hatred for Christians and Jews.

“Islamic-based organizations, terrorist groups and their supporters hate the Jews, Israel and Americans. When we hear them say they want to wipe out Israel, they’re serious. The U.S. has to take their threats seriously,” Gaubatz said.

Kutnicki agreed that ISIS and other jihadist groups are targeting the U.S.

“The U.S. is in grave danger because the Brotherhood Mafia (Muslim Brotherhood) is embedded in all of the relevant power centers. This goal of domination is why there are jihadi cells preparing for battle in multiple training camps. Jamaat Al-Fuqra is in the forefront on the Sunni side, and Hezbollah camps on the Shia,” Kutnicki said.

World Net Daily, ‘Presbyterian Church USA Named In IRS Complaint’, dated 11/4/2014:

” Israel-based intelligence analyst Adina Kutnicki said the PCUSA’s actions have made news in some conservative Israeli outlets.

“Israel National News, Arutz Sheva and a few other pro-Israeli sites have taken note of the action. However, it has largely been kept out of the mainstream media in Israel,” Kutnicki said. “Yes, the left, as in America, controls the mainstream channels.”

Darshan-Leitner also said none of the organizations that support the wider BDS movement support Israel’s right to exist.

“They don’t even believe in the right of Israel to exist along with a Palestinian state. They only believe in a one-state solution, and that’s a Palestinian state. This is entirely an effort to delegitimize Israel and finally reach their goal of the dissolution of the state of Israel,” she said.

She believes that in the end, the IRS will see the wisdom of the complaint and revoke the church’s tax-exempt status.

Kutnicki also believes the complaint has a solid legal basis.

“As to Shurat’s charge, well, it is absolutely the case that under non-profit rules, whether it’s a 501(c)3 or a 501(c)4 or other variant, it is absolutely forbidden to inject political directives into said organization,” Kutnicki said.

Kutnicki said Darshan-Leitner and her organization are “rock stars in the pro-Israel public.”

Kutnicki said that in a lengthy list of “knockout punches” is a recent win in a New York court against the Palestinian Authority on behalf of 11 families who were victims of terrorism.

She said that through the BDS movement, the Muslim Brotherhood and its front groups “are locking arms with Islamists.”

Kutnicki said there are many who are trying to smear Shurat HaDin’s reputation by describing it as an arm of the Israeli government.

She insisted it is “nothing of the kind.”

“In fact, the ruling left, and the left does execute policy in Israel, regardless of who sits at the helm, attempts to block and smear Shurat at every turn,” Kutnicki said.

    We are tired of hearing that withdrawal from Judea and Samaria will bring peace. We know and you know that it would bring another Gaza. So stop saying it and promoting this fallacy. Past experience has proven that concessions, appeasement and land for peace only increased terror, violence and more conflict.

    We are tired of hearing that land beyond the Green Line is ‘Palestinian land’. The Green Line is simply an armistice line that has no political significance. You know this too. The San Remo Treaty of 1920 Granted the Mandate for Palestine to the Jewish people, the same Allied powers also established 21 Arab States and one Jewish State – The Arabs are not willing to give up any part of the 21 Arab States and the Jews are not willing to give up any part of the Jewish State.

    We are tired of hearing about the “Palestinian people.” They are no different from the Arabs of Syria or Egypt, from which most of their ancestors migrated in the last 150 years or so. There is no Palestinian language or religion, and until very recently they considered themselves simply ‘Arabs’. Their culture is almost entirely defined by their opposition to the Jewish state. There never was an Arab-Palestinian State or people in History. The Arab Palestinians have a State in Jordan which is 80% of the land originally allocated to the Jewish people under the San Remo Treaty of 1920.

    We are tired of hearing that “the Palestinians deserve a state.” We are indigenous here, not them, and their behavior entitles them more to a trial at The Hague than to a state. The Arab Palestinians have a State it is called Jordan which was carved out of Jewish allocated land.

    And they certainly don’t deserve our state, which is the only state they want. They already took 80% of Jewish allocated land which is Jordan. Israel also gave them the Gaza Strip.

    We are tired of hearing about ‘The Occupation’. As Minister Naftali Bennett said the other day, you can’t be an occupier in your own land. The Arabs are the occupiers, Greater Israel has been a Jewish state for 4,000 years even if it was temporarily conquered and occupied by various nations over the centuries.

    We are tired of hearing that “settlements are illegal under international law.” They are not. The San Remo Treaty of 1920 expliciptly stated that Jewish people can reside anywhere in the Mandate for Palestine, those terms are set in perpetuity.

    We are tired of hearing that “settlement construction is an obstacle to peace.” Arab rejectionism and terrorism is the reason there is no peace. When the Arab-Palestinians teach and preach hate, terror and destruction to their children, this is definitely not a road to peace and coexistence.
    By the way, we are pro-peace. We are just not pro-suicide and self destruction.

    We are tired of hearing about the 5 million (or whatever ridiculous number there are alleged to be) ‘Arab-Palestinian refugees’ or the ‘Arab-Palestinian diaspora’. There were about 600,000 Arabs that left their homes in 1948, mostly of their own volition, more or less at the same time as the 980,000 Jewish refugees from Arab countries, of which the Arabs confiscated their homes and assets. We resettled ours with limited land and resources — resettle yours, the 21 Arab states have more land and resources.

    We are tired of hearing anything from anyone associated with the U.N. The U.N. is a parasitic and criminal enterprise dominated by our mortal enemies. The U.N. cannot create states, it can only recommend and so can other nations only recommend and not create a state that never existed before in history. If they want an Arab-Palestinian state, it already exists, it is Jordan which has taken 80% of Jewish allocated land.

    We are tired of stupid post-colonialist rhetoric. We are not ‘colonists’ and Arabs do not have the right to murder us in the name of ‘resistance’ or beheading Jewish Rabbi’s in Jerusalem’s Har Nof Synagogue. Talking this way reveals you as moral imbeciles. They train their children to be suicide bombers.

    You can not recognize a state and people that never existed and that has no borders, no single government, and no economy. They are not trusted by Arab states either.

    We know we can not depend on any kind of security guarantee from anyone except the Israel Defense Forces. So stop being insulted because we do not trust you. And do not ask us to give up any nuclear weapons we might or might not have or any other method and technology that could help protect us.

    We know that the left-wing parties in Israel are bankrupt of ideas. We are not going to vote for them, no matter how much you would like us to. So do not bother trying to influence our election. We will only vote for a government that protects its people and cares about the Jewish heritage, more than it cares for world opinion.

    Don’t believe what you read in Ha’aretz newspaper, they represent a minority that has no allegiance to the Jewish heritage.
    Jerusalem, undivided, is the capital of the state of Israel. Get used to it, because you can’t change it, the Jewish temple will be rebuilt in Jerusalem.
    Ordinary Israelis who care about their heritage.

  10. I totally agree with above comments. I make it clear; I am not, and was not born Jewish. That is significant because nobody will accuse me to be onside.
    I was born in Poland and have seen and heard from my father, who lived in Lublin district, about terrible intolerance Jewish people had to endure. Nerveless, they managed to survive 5000 years! I respect that very much.
    I do support IDF because this is not offensive Army. People of Israel had to defend themselves. Today and in past years the build green Israel, and economy and parasites, so called “Palestinians” want to rob it. Yes, when Israel is desert again there will be peace.
    If someone want to live in piece he engage in production and trade of goods not in military and terrorist activities. I have written to present Prime Minister in 9/12/01 to finish evil for good. Romans overrun Masada, but this time Masada is Israel itself with big difference – people are willing to live and be victorious in that!

  27. A short synopsis of Jewish History and the Arab Israeli conflict by YJ Draiman

    Jews have the absolute right for their homeland. Zionism the movement itself was created during the second half the 1800′s. Jews purchased a substantial amount of territories in Palestine-Israel (see testimony of the Mufti of Jerusalem in front of the British Peel Commission) from local sheikhs and lords and built settlements there. This dates as early as 1860, that is 79 years before WWII.
    During all of this time Jews kept migrating back to their historic homeland which comprised of two kingdoms: the Kingdom of Israel and the Kingdom of Judah. They were driven out of the Kingdom of Israel by the Assyrians in 720, B.C.E. The Babylonians in 586, B.C.E., drove the Jews out of the Kingdom of Judah, including Jerusalem. Then followed the Persians in 536, and the Hellenistic Syrian Seleucid Rulers in 332 BCE. Jews – The Maccabees re-conquered Israel in 166 BCE.
    Romans conquered Israel in 63 C.E., and in 70 A.D. destroyed the Jewish second Temple.
    Which was followed by these conquests:
    Byzantines in 313; Persian in 614; Arabs Muslims 636 CE; Crusaders 1099; and the Mamluks in 1291.
    Then came the Ottoman Empire in 1517. In 1564 the Ottoman Empire encouraged and stimulated Jewish immigration which added over 10,000 new Jewish returnees to Palestine-Israel (The Ottoman land records for Palestine showed that the government owned over 90% of the land) and the British Rule 1918-1948.
    During the time of the Roman rule of Israel, the Jews in the kingdom called Judea revolted against the Roman rule. The Romans crushed the rebellion, exiled many Jews out of the country, seized many others and turned them into slaves deporting them to Rome and other places. Not only that, they changed the name of the land from Provincia Judea to Palestine to humiliate the Jews.
    For 600 years or so, Arab Muslims imperialism spread throughout the Middle East from Arabia. Among other conquests, the Arabs conquered Judea-Palestine, killing many of the local Jewish population, and converting many into Islam. The story of how the Arabs got to Palestine is the story of conquest, imperialism and occupation.
    During the 19th and 20th century, when Arabs had little to no interest in the land of Israel, Jews bought massive amounts of land and resettled there. After WWI the Allied Powers, the international community and the League of Nations under the San Remo Treaty of 1920 assigned the British “The Mandate for Palestine” as trustee over the land so that a Jewish state would be created in that land. The British had their own agenda in mind.
    The original Mandate territory included what is today Israel; Gaza, Parts of Sinai, West Bank (Judea and Samaria), Jordan and the Golan Heights. The British had their own agenda and divided the country up. They gave to the Arabs the allocated land which had been Mandated to the Jewish people in violation of the San Remo Treaty of 1920: everything East of the Jordan river. This land which was intentionally given to the Arabs constituted 80% of the land allocated to the Jewish people. The British gave the land to the Hashemite Kingdom for the Arab population in order to create a new State: Trans-Jordan. The British also traded the Golan Heights to the French who ruled Syria for oil in Iraq. Thus, after already separating the country into one Arab state Trans-Jordan, which is present day Jordan, they intended to break up the remaining Jewish land West of the Jordan River, present day Israel and wrongfully give it to the Arabs.

    In the meanwhile a conflict emerged over territorial boundaries between the Jewish inhabitants and the Arabs. The U.N. proposed a deal to split the remaining land of the British Mandate for Palestine (yes, split yet again) into an Arab state and a Jewish state. The Jewish leadership accepted the proposal, provided the Arabs also accept it. The Arabs declined. Thus the 1948 war began. A war in which the Arabs with armies from Egypt, Syria, Jordan, Iraq, Lebanon and local militias of Arabs, and help on a smaller scale from the armies of Algeria and Libya attacked the new Jewish entity. The Arab coalition had the weapons and a large army and were confident on victory, to the extent, that they asked the local Arab inhabitants to vacate the land while they decimated the Jews. But fate had other plans. Through divine intervention, the Arabs lost that war. Many Arab civilians fled their homes because their Arab leadership told them to. Some were panicked by rumors. There were only a few incidents with civilians. (It is an important fact that during the war of 1948, Jewish settlements that were seized by Arab forces were razed to the ground – Kfar Etzion for example and the remaining population there killed).
    The true and detailed facts and history is much more voluminous and complex. The problem Israel faces is that it is not as quick to explain the 4000+ years of Jewish history in Israel to counter the Arab lies and propaganda. Lies are easier to spread. However, upon close examination of the historical facts, the lies are exposed as baseless propaganda and should be dismissed as such.
    It should be noted only a small segment of history is being presented here. I did not enumerate anything about how Arabs used terror and violence since the beginning of the conflict. I did not mention that before Arab nationalism and Muslim radicalism took over, the small Arab community was glad that the Jews were coming back to their ancestral homeland, providing an economic boost and jobs to the region, (even king Faisal was delighted.) I did not enumerate or discuss in detail the Arab-Palestinian refugees without telling how and why they became refugees.
    I might also mention that the Arab countries expelled over a million Jewish people, confiscated their assets, businesses, homes and land (120,000 sq. km. which is five times the size of Israel and valued in the trillions of dollars). About 650,000 of those Jewish refugees from Arab countries were resettled in Greater Israel.
    It is time for the Arab countries who expelled the million Jewish people to resettle the Arab-Palestinian refugees in their own countries, and or Jordan, and put an end to this conflict and ending the misery and displacement of the Arab Palestinians. This will bring about peace and coexistence which the people so rightfully desire and deserve. It will bring economic prosperity and an increase in the standard of living for all the people.

  28. Israel does not have to defend its’ legitimacy! r3
    Israel’s rights to the land is ingrained in history, archeological findings, international law and possession. Just like the Arab States have not been required to defend their legitimacy, Israel should also not be required to defend its’ legitimacy. The 21 Arab States and the State of Israel were set up by the Allied Powers after WWI, when the Ottoman Empire relinquished its title to the territories to the Allied Powers. The British were assigned as trustee for the Jewish people to help reconstitute the Jewish State as Implemented by the San Remo Treaty of 1920. The San Remo Treaty adopted the Balfour Declaration of 1917. Of importance is the fact treaty terms and documents prove there was no state allocation of land to any other people or nation other than the Jewish people in Israel. It should also be noted the League of Nations set up the Mandate for Palestine as a State for the Jewish people with exclusive political rights.
    The Jewish people who lived in Israel for over 4,000 had additional Jewish immigration in the mid 1800. The local Jewish people with the infusion of more Jewish immigration, resources, funding and with the explicit permission by the Ottoman government, started developing the land. Within a short time the Jewish people started turning the desert and desolation into green pastures, thus, building an economy, agriculture, housing and industry. Many Arabs from neighboring depressed states who viewed this development as an opportunity for work and an improved standard of living, came to work in Palestine.
    The Arab countries expelled over a million Jews, confiscated their assets, businesses, homes and land 5-6 times the size of Israel. Most of these expelled Jews from Arab countries were resettled in Greater Israel.
    Over the past 68 years Israel has become a thriving nation with exemplary innovation in education, technology, high tech industry and medicine. Many nations admire Israel’s outstanding development and innovation. Israel has always been extending a helping hand to any nation that wants to learn and advance in industry, technology and medicine.
    The Arab-Palestinians saw an opportunity to get land and a country that was developed and flourished by the Jewish people. They decided that through intimidation, harassment and violence to usurp the Jewish habitants into capitulating to their scheme of an Arab-Palestinian State on Land allocated to the Jewish people . The Arab-Palestinians live on charity from the nations of the world. They are unwilling to help themselves. After the 1967 war when Israel defeated the 5 Arab armies who tried to destroy it, Israel started employing many of the Arabs in the liberated Jewish territory, educating them in agriculture and water resources. In the following years the standard of living of the Arabs jumped 5 fold and more, and their economy and housing blossomed. When the terrorist organization entered the picture and instigated the Arab population to start terror and violence against the Israelis, the economic advancement was slowed down if not halted. The dire predicament of the Arab-Palestinians is of their own making.
    If you look at Arab land it is desolate and barren, with few exceptions. At the same time, the Jewish land is blooming and developing at an accelerated tempo. The Arabs, rather than follow the example set by Israel, tried to take the Jewish land by force and lost 4 wars in a span of 25 years.
    The Arab-Palestinians current actions in the political and legal arena is a result of losing 4 wars and various battles with Israel. They not only could not win ground, but in fact have caused themselves a downward spiral toward economic desolation.
    The Arab-Palestinians have switched tactics and have now gained more ground and concessions by playing the peace game. The Arab-Palestinians obfuscation and disinformation campaign along with various pleadings in front of the U.N. and other International bodies has gained them more inroads. The power of oil and the Arab Countries, who do not want the Arab-Palestinians to return to their countries, are helping them promote the false information, and utilizing their numerical control in the U.N. to pass any resolution that they deem necessary to advance their cause.
    Money, power and greed promoted hate and anti-Semitism by the Arabs in order to force Israel into surrendering territory to the Arab-Palestinians. The Arabs are trying to initiate land piracy camouflaged as legal rights to the land of Israel.
    Jewish resistance to persecution by the Arabs and the world at large: Any level headed individual would think that after WWII and the 6 million Jews exterminated in the Holocaust (plus another 5 million of other ethnic groups) would diminish, if not eliminate anti-Semitism and baseless hatred. It seems that no matter the amount of unwarranted persecution, and no matter the sacrifices the Jewish people have endured through the ages, Anti-Semitism continues to raise its ugly head.
    The Media is guilty of escalating hostilities and violence in Israel and elsewhere. The Media has a responsibility to deliver fair and unbiased reporting. They influence the information that people rely on. It is an awesome responsibility and it must be handled with factual un-slanted reporting. Peoples lives depend on it; maybe yours or someone you love. I would like your comments and input.
    The affects on the world at large: Has humanity lost its values and fairness? The answer is no. In order to lose something, one must first possess it and the truth is, the world has never had total control of values and fairness. In today’s world, where money and power is pursued at all costs (see Machiavelli) , the core family unit is disintegrating and family values deteriorating. Honesty, integrity and fair-play seem to be a thing of the past. Where are we as human beings of the 21st century heading? Obviously downward.
    Take some time to reflect on the truth of what is stated here. Do you really want this kind of world for your children? Senseless hate and destruction must not be tolerated. I urge you to wake up, take the bull by the horn and pursue a path of correction, or we are doomed as a civilized people.

  34. Dear Adina,

    Thank you so very much for writing about the inaccurate and biased information about Islam, Israel, Muslim-Jewish relations, Israeli, Jewish, and Islamic history, and similar topics distributed to students in Newton, MA and other school districts, and how this material gets into our schools.

    I do have a concern, however, about the photo of the American Peace and Tolerance advertisement used as a graphic in the piece. Much as I hate to say it, thet advertisement is actually inaccurate and misleading, and its publication by Americans for Peace and Tolerance put us back months if not years in removing anti-Israel materials from the schools.

    I could write paragraphs about what is wrong with the ad, but in brief:

    – The Arab World Studies Notebook (except for one teacher who I believe just made an oversight) hasn’t been used in Newton since 2012 (as far as I can tell). Although I’m certainly not going to overlook its continued use by that teacher, it’s misleading to state it’s still in general use.

    – The “Flashpoints” website was definitely removed by the library in 2012 (I checked)

    – The article “A World Where Womanhood….” is the one resource that was actually used to stimulate a discussion on the issue, not as purported work of historical accuracy. Numerous students reported this to us, which is why I didn’t include it in the PENS website and why it wasn’t included in the Verity Educate a report. Of course, a truly neutral discussion would also utilize a work from a woman who was forced to wear the burka against her will, and this has been pointed out to the school, but again it’s misleading to state that they are ‘learning’ that the burka is great – it’s very clearly just one woman’s point of view.

    – Posting the photos of Fleishman and Hills really aggravated them, as did the (unintentional) use of Matt Hill’s home phone number. These are the people who have the ability to remove the materials from the schools. Much as I truly dislike Hills and Fleishman and believe that they should be removed from their posts, deliberately antagonizing them is not a good way to approach the issue.

    I can’t overstate the negative effect this advertisement had. At Newton North High School, 500 out of 2,000 students signed a petition against it in just one afternoon, mostly because of the inclusion of the “A World Where Womanhood…” article. The advertisement is also the reason why Matt Hills retaliated against my daughter – he did this the two days after the ad was printed and according to another School Committee member, the retaliation was based on Hill’s “frustration” about the ad and the calls.

    APT, ONE and Charles Jacobs (head of both organizations) posted the ad without having ever tried to speak with school administrators, providing any evidence to them about why the materials were bad (instead of just saying they’re bad), or consulting with PENS even though he knew we had been working on the issue, in conjunction with a couple of relatively sympathetic school officials, for nearly three years. It gave the NPS the excuse they wanted to ignore us and other pro-Israel advocates; it took fourteen months after its publication to schedule another meeting with school officials.

    I eventually had to write an “Open Letter” to Jacobs asking him not to publish advertisements or other work without doing research first (he knew or should have known that there ASWN was removed; it was very big news), not to publish items relating to issues he had never worked on and didn’t know anything about, and not to take credit for other people’s work (which he’s continually done).

    Would it be possible to remove the advertisement from the post? Its inclusion implies that we (and you) approve of and support the advertisement, which would have been true if the advertisement was accurate; however unfortunately it is not.

  43. It is time to factually clarify the legal status of Judea and Samaria under international law.

    “When the occupant is not the one you want to believe in”

    In 1967 Israel liberated occupied Jewish Palestinian territories. For the enemies of Israel and many of Its’ friends, and for a majority of Israelis, this is a basic axiom. During the Six Day War, it is stated that Israel liberated and captured the Jewish Palestinian territories, resettled and installed there Its’ “settlers” with impunity and in obvious violation of international law. Is this axiom a lie? If international law asserts the exact opposite, for obvious political and diplomatic reasons, then the facts have been ignored and have instead embraced the current unfounded and false Arab propaganda. This understanding is a misconception and false.

    It is time to clarify and illustrate the Jewish legal status of Judea and Samaria under international law. One only has to read the documents. However, the Media has without a doubt, immersed itself in hearsay and untruths, twisting facts and ignoring the truth. It is time to examine the real truth and facts as supported by documents and history.

    We hardly talk about it, yet, when looking at historical documents on the legal status of Judea and Samaria, one finds powerful arguments against all critics who accuse Israel of occupation of the territories. It must be noted it doesn’t matter if these critics are Arabs, Americans, Europeans or even members of the Israeli extreme left.

    The San Remo Treaty of 1920, written almost a century ago and confirmed by the 1920 Treaty of Sevres, forms the foundation of truth. Yet, it seems hardly anyone in the Prime Minister’s office, the Minister of Foreign Affairs, or Hasbara has taken the time to build a strategy based on said Treaty and other documents which followed that prove clearly that Israel is far from the colonial power it is being accused of being since 1967.

    When considering the media archives that preceded the Oslo Accords (which are now null and void), we realize that the official Israeli narrative concerning the Israeli presence in the West Bank was much less ”worried” then today. Until 1993, Israel gave the impression of not requiring justification for rebuilding Jewish settlements beyond the Green Line. Until that time, Israel did not seem to plead for the international community and the Arab world in particular to give It the acquiescence of keeping the famous “settlement blocs.”

    According to Prof. Eliav Cho’hatman, lawyer and lecturer at the Graduate Institute of Law “Shaare Mishpat,” there is no doubt that the Oslo Accords marked the starting point of this attitude it deems “catastrophic”: “Until then, our leaders did not hesitate to brag our rights over all the land of Israel from the point of view of international law but since the agreements were signed, only security patterns are referred to plead that part of these territories we are entitled to remain in our hands.” Prof. Cho’hatman says he sent to Prime Minister Binyamin Netanyahu during his first term (1996-1999), his work on the above, but regrets that the head of government has not availed itself: “When I heard of two states for two peoples, I understood why.”

    To understand this issue, we must examine Balfour Declaration and San Remo Treaty which was confirmed in the 1920 Treaty of Sevres, a little less than a century ago, November 2, 1917, to be precise. At that time, Lord Balfour, Foreign Minister of Great Britain, in writing, and in agreement with Chaim Weitzman, then president of the World Zionist Organization, wrote in an official letter to Lord Lionel Walter Rothschild, honorary president of the Zionist Organization of England, the following. In this letter, the UK is in favor of the establishment of a national home for the Jewish people in Palestine. This is the famous “Balfour Declaration” which raises unbridled hope in the Jewish world. In the aftermath of World War I, the League of Nations entrusted to Britain a Mandate over Palestine as trustee for the Jewish people over all of Palestine.

    Three years after the Balfour Declaration in 1920, the conference was held in San Remo, Italy during which the great powers decided how to split the territories conquered during the war. At this conference, it was decided to incorporate the 1917 Balfour Declaration into The San Remo Treaty of 1920 (its terms are in effect in perpetuity) and confirmed by the 1920 Treaty of Sevres, it set the British Mandate for Palestine as trustee for the Jewish people. This decision confirms the international recognition of the Jewish right to self-determination in Palestine and the mandate for Britain to “work towards the realization of this statement to reconstitute a national home for the Jewish people in all of Palestine” (Balfour Declaration). It must be noted, the San Remo Treaty did not grant any other nation or people land in any part of Palestine, only the Jewish people. Including the incorporation of the Balfour Declaration into the Palestine Mandate by the United Kingdom, this text is the same international resolution supported by the 52 member countries of the League of Nations, and later by the United States, which would become a member of the international organization a few years later.
    The San Remo Treaty of 1920 and its terms to reconstitute the Jewish people in its ancestral land was reconfirmed in the 1920 treaty of Sevres and the treaty of Lausanne.
    British Mandate for Palestine
    The three principles of the British Balfour Declaration regarding Palestine as a reconstituted Jewish country were adopted in the 1920 Treaty of Sèvres:

    ARTICLE 95.

    The High Contracting Parties agree to entrust, by application of the provisions of Article 22, the administration of Palestine, within such boundaries as may be determined by the Principal Allied Powers, to a Mandatory to be selected by the said Powers. The Mandatory will be responsible for putting into effect the declaration originally made on November 2, 1917, by the British Government, and adopted by the other Allied Powers in the San Remo Conference, in favor of the re-establishment in all of Palestine a national home for the Jewish people, it being clearly understood that nothing shall be done which may prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country and granting the Jewish people exclusive political rights in Palestine.

    Palestine officially fell under the British Mandate as trustee for the Jewish people.

    French Mandate of Lebanon
    The French Mandate was settled at the San Remo Conference. Comprising the region between the Euphrates River and the Syrian Desert on the east, and the Mediterranean Sea on the west, and extending from the Alma Dagh Mountains on the south to Egypt on the south; Area of territory about 60,000 sq mi (160,000 km2) with a population of about 3,000,000. Lebanon and an enlarged Syria, which were later assigned again under League of Nations Mandate. The region was divided under the French into four governments as follows: Government of Aleppo from the Euphrates region to the Mediterranean; Great Lebanon extending from Tripoli to Palestine; Damascus, including Damascus, Hama, Hems, and the Hauran; and the country of Mount Arisarieh.

    French Mandate of Syria
    Faisal ibn Husayn, who had been proclaimed king of Syria by a Syrian national congress in Damascus in March 1920, was ejected by the French in July of the same year.

    The San Remo Treaty of 1920 – some relevant terms
    In paragraphs 5, 6 and 7 of the Protocol of San Remo, we read: “No territory of Palestine will be sold or leased or held in any way under the control of the government of any foreign power.” Or: “The Administration of Palestine, while ensuring that the rights of other parts of the population are not altered, shall facilitate Jewish immigration under suitable conditions and encourage, in cooperation with the Jewish Agency; The dense settlement of Jews on the land, including State lands and waste lands not required for public purposes. ”

    Finally, the Palestine Mandate states: “the Administration of Palestine is responsible for the adoption of a law on nationality. Included in this law must be provisions framed so as to facilitate the acquisition of Palestinian citizenship by Jews who acquire permanent residence in Palestine.” At that time, it must be remembered, Palestine is not just the west bank of the Jordan. Rather, it also includes, most importantly the majority (approx. 77%) of the territory which is the east bank of the Jordan River, where today is located the new State of Jordan.

    Britain reneged on its promises
    What happens next is related to internal political changes in Britain and the election of a government hostile to the creation of a Jewish homeland throughout the territory of Palestine. Thus Britain, having clearly supported the conclusions of the San Remo Conference of 1920 and its confirmation in the 1920 Treaty of Sevres, changes its mind in violation of the treaty and weaves very tenuous diplomatic ties with the Arab countries surrounding the area of Palestine and with several Arab leaders (to control natural resources, such as oil).

    If one argues that the perpetual right of Israel to all of Palestine has been abrogated, then one also brings into question the status of the Arab states that were created by England in the aftermath of World War 2. The legality of these Arab states that were carved out of the defunct Ottoman Empire also rests on the same “trusteeship system” installed after the first world war by the community of nations. In fact, the Weizmann-Feissal agreement of the 1919 peace conference talked of one Jewish state (all of Palestine) and only one Arab state (the other 99.9% of the Middle East).

    The creation of Transjordan on Jewish land It was after this diplomatic rapprochement that Transjordan was created in 1922. Transjordan is a semi-autonomous state like Britain led by Abdullah Hussein, son of Sharif Hussein of Mecca Ibn Ali, and great-grandfather Abdullah, the current king of Jordan. However, in regard to the West bank (Judea and Samaria) of the Jordan river, and the West Bank (Judea and Samaria) nothing has changed. Per San Remo Treaty and all subsequent agreed to documents, these regions are still part of the territories over which the Jewish national home has to be re-established as confirmed per the 1920 Treaty of Sevres.

    According to many lawyers, Professor Julius Stone, Howard Grief, Stephen M. Schwebel, Former ICC Judge including Prof. Dr. Cho’hatman with Talya Einhoren, and American lawyer Eugene Rostov, one of the drafters of the famous U.N. Resolution 242 which is the partition plan of November 29, 1947, does not change the situation either. Indeed, having been adopted by the U.N. General Assembly and not by the Security Council, it cannot be considered legally binding. Legally, it is only a recommendation that obtains legal validity in case of endorsement by the parties in question: the Jews and the Arabs. This plan was rejected by the Arab powers, thus, its status remains protocol. For other lawyers, the partition plan has transformed the status of the Judea and Samaria territories into one of dispute. On one hand, the Territories are not part of the state of Israel created in 1948. On the other hand they do not belong to Jordan which occupied those lands from 1948 to 1967.     The Jordanian occupation
    Did the Jewish people temporarily lose the rights to Judea and Samaria with the Jordanian occupation between 1948 and 1967? For many lawyers, the answer is no. Jordan proclaimed Itself sovereign of the territories after the war of independence with the support of only two countries, Britain and Pakistan. Moreover, the same Jordan decided in 1988 to abandon its sovereignty in Judea and Samaria. Incidentally, the term West Bank formally is no longer needed. It should also be known that many Arabs in the West Bank also known as Judea and Samaria are citizens of Jordan.

    The dissolution of the League of Nations
    Does the dissolution of the League of Nations which was replaced by the UN, and the end of the British Mandate for Palestine cause any change in the rights of the Jewish people to their land? Again, the answer is no because, under section 80 of the UN Charter, “nothing in this Chapter shall be construed as affecting directly or indirectly in any manner the rights whatsoever of any states or any peoples or the terms of existing international instruments to which Members of the Organization may be parties.” Clearly, this means that the UN committed in 1945 to protect the legitimacy of the Jewish land rights established by the League of Nations, The San Remo and the confirmation by the 1920 Treaty of Sevres .

    For Professor Eugene Rostov, mentioned above, this means that “the right of the Jewish people to settle in the land of Israel has never been interrupted on all the territory west of the Jordan River, and since a peace agreement has not and will not be signed between Israel and its neighbors the status has not changed.” He later wrote that under all international treaties and agreements, “Israel has an undeniable right to establish settlements in the West Bank.”

    No unilateral approaches
    Did the Oslo agreements affect the status of Judea and Samaria under international law? Again, the answer is to be found in the texts themselves. Indeed, it is stated in the preliminary agreement in 1993 that the final peace agreement will be signed by both parties “through negotiations.” The agreement, called Oslo II and ratified in 1995 (which is currently null and void), provides for its part that neither side “does not initiate or commence proceedings which can change the status of the West Bank and the Gaza Strip to the end of negotiations on the final peace agreement.” Any unilateral approach – such as the announcement in September by the Palestinians of an independent state – will therefore be in stark contrast not only with the Oslo agreements (which may be null and void) but also with resolution 242 of the UN that supports the right of each party to “live in peace within secure and recognized borders.” The borders of a proclaimed Palestinian state are of course far from being “secure and recognized” in the view point Israel. Incidentally, Resolution 242 does not speak of, thus, does not apply to any such Palestine, rather, only to existing states, that is to say, Jordan, Egypt and Syria.

    Do not just be right, but also know
    There are other arguments for the legitimacy of the Jewish presence in Judea and Samaria. For example, the fact that these territories cannot be considered ”busy” since they do not belong, de facto, to an enemy state. Or inconsistency of the term ”1967 borders” which are not borders but the cease-fire line between Israeli and Jordanian armies at the end of the 1967 and 1948 War of Independence. Legally, Israel is therefore in a rather comfortable and sound position.

    Yet these arguments are not raised. The reasons? There are many: Israel and the Israelis became convinced themselves that they were a colonial power and archives in the world will not be able to release this distorted image. Also in Jerusalem, it probably feels that right or not right, the world has already chosen sides. In the corridors of the Foreign Ministry, it is even said that under international law, “it is 99% perception, and 1% enactment of factual law.” But in Israel, there is another expression that says it is not enough to be right, but you must also be smart. And now for the good of the State of Israel, “be smart” is to make the world know what is right.

    The Jewish and Arab Refugee resolution Since the late 1940’s the Arab States have expelled over a million Jewish people. They confiscated their assets, businesses, homes and Real Estate which is 120,000 Sq, Km. (46,000 sq. miles, about 5-6 times the size of Israel) and is valued in the trillions of dollars. The State of Israel has resettled the majority of the million Jews expelled from the Arab countries in Greater Israel. The Arabs claim that about 600,000 Arabs were displaced from their homes during the 1948 war. Most of the Arab population abandoned their homes at the request of the 5 Arab Armies who were sure to defeat the newly reconstituted Jewish State. About 300,000 Arabs out of the 600,000 stayed. Now the Arab and Jewish population has increased dramatically. Many new Arabs have moved into the area, and many new Jews from the Holocaust and other areas have emigrated to Israel. It is about time that the Arab countries that expelled over a million Jews should resettle the Arab refugees in their vast lands. Utilize the funding which is given to the Arab refugees (instead of using it for weapons and war) to relocate, build housing, schools, commerce and industry and resolve this tragedy once and for all. This will bring peace and tranquility to the region.

Brinton, who appealed against a US district court’s withholding of State Department documents concerning US policy on issues involvingIsrael and the West Bank, the Golan Heights, and the Gaza Strip. He showed that none of these areas fall within the definition of “occupied territories” and that any claim that the West Bank, the Gaza Strip, or both, is a Palestinian homeland to which the Palestinians have a ‘legitimate right’ lacks substance and does not survive legal analysis. According to Mr. Brinton no state, other than Israel, can show a better title to the West Bank.
    Sir Elihu Lauterpacht CBE QC., the British specialist in international law, who concludes inter alia that sovereignty over Jerusalem already vested in Israel when the 1947 partition proposals were rejected and aborted by Arab armed aggression.
